DISPUTE RESOLUTION FOR CONSTRUCTION AND REPAIR CONTRACTS

The Wake County Board of Education establishes this dispute resolution system to facilitate the prompt and fair resolution of disputes with amounts in controversy in excess of $15,000 arising between or among any parties involved in the school system's construction and repair projects (including the school system, the architect, the construction manager, the contractors, and the first‑tier and lower‑tier subcontractors) on claims arising out of the contract or construction process in accordance with N.C. Gen. Stat. § 143‑128(g). The Board strives to resolve disputes without animosity between or among parties. To this end, the Board believes that an architect's review followed by mediation as necessary or desired shall be preconditions to litigation of any dispute covered by this policy. In no event shall the Board be subject to arbitration proceedings pursuant to this policy. The superintendent or his designee shall adopt regulations to implement this policy.
